UKCA Update: Relevant changes for companies exporting to the UK

The UK government has eased the requirements in the UKCA compliance procedure.

1. New certifications are no longer mandatory

Conformity assessments for CE marking completed by December 31, 2022, can be used as a basis for UKCA marking. The decisive date is therefore the contract date, i.e. even if machines are not placed on the market in the UK until 2022, they no longer necessarily need a UKCA marking, provided a CE conformity assessment has been carried out by the end of 2022. This will apply until the certificate expires or for five years (December 31, 2027), whichever comes first. This means that a new certification is no longer mandatory.

2. Already imported goods do not need to be relabeled

It is no longer necessary to subject goods that have already been imported to a conformity assessment again, as these products are deemed to have already been placed on the market in the UK. This avoids costly relabelling of existing inventories. This means that inventory can be expended without any problems.

3. Spare parts of already imported and compliant goods do not require further UKCA marking

From now on, it is sufficient that spare parts of goods that have already been placed on the UK market meet the same requirements that applied when the original goods were placed on the market. This means that spare parts of CE-marked goods must continue to bear only the CE mark. This allows products, for which spare parts are required, to continue to be serviced without difficulty. However, the intended use of the spare parts must be adequately documented.

4. The UKCA mark may also be applied to accompanying documents or labels

Previously, the regulation applied that the UKCA marking had to be visibly attached to the goods, the packaging or alternatively in the operating instructions. However, this has now been eased and, with immediate effect, the UKCA marking can also be affixed to an accompanying document or label. Companies can therefore implement UKCA marking more flexibly and at a cost-efficient time. Please note that this regulation is also only valid until 31.12.2025.

In making these changes, the UK government has responded to feedback from the industry. However, it must be remembered that these changes do not apply to medical devices, construction products, cable cars, unmanned aerial systems, transportable pressure equipment, rail products and marine equipment. Separate agreements will be made here.

Furthermore, the original UKCA marking obligation will apply from 01.01.2023. This deadline applies in particular to products for which a CE conformity assessment is not yet available.
