Within the European Union (EU), CE marking is mandatory for machines, systems and electronic devices. With a CE marking, the manufacturers of a machine declare that it has undergone the prescribed EU conformity assessment procedure and complies with all applicable European regulations.  The responsibility for the legally compliant execution of the conformity assessment procedure and the correct affixing of the CE mark lies with the manufacturer and, if applicable, the user himself. WHEN IS A CE-MARKING REQUIRED?

The CE mark is a marking by which a manufacturer of a machine expresses that the machine complies with all applicable EC directives. A CE marking is not only required when a machine is first placed on the market and sold by the manufacturer (placing on the market), but also when the user of a machine makes substantial modifications to it, links it to other machines or constructs machines for his own use.

In the case of a substantial modification or a concatenation of several machines (Assembly of machines), the machine user legally becomes the manufacturer. This means that he must not only fulfil his obligations under the Ordinance on Accident Prevention (Safety – SR 832.30) and Ordinance 3 on the Labour Act (Health – SR 822.113), but also those of the Machinery Directive (2006/42/EC)(1)

(1) transposed into Swiss legislation by the Machinery ordinance (SR 819.14).

In the following cases, manufacturers and operators must aplly a CE Marking:

  • Placing on the market: Sale or first placing on the market
  • Construction of a machine for own use
  • Significant changes to machinery or equipment
  • Interlinking of several machines or plants (Assembly of machines)

WHEN IS A SIGNIFICANT CHANGE TO A MACHINE OR PLANT?

As soon as a significant change is made to a machine or plant, the machine user is no longer exclusively bound by the Ordinance on Accident Prevention (Safety – SR 832.30) and Ordinance 3 on the Labour Act (Health – SR 822.113) for the safe operation of work equipment, but is also responsible for compliance with the Machinery Directive. A significant change may be present if the user, for example, changes the design or intended use of the machine or increases the original performance.
